Terms of Service¶

PLEASE READ THIS AGREEMENT CAREFULLY REGARDING THE TERMS OF SERVICE (HEREINAFTER — "TERMS"), AS THEY CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND HOTLINE ("HOTLINE", "WE" AND DERIVATIVES). THIS WEBSITE AND ANY OTHER HOTLINE WEBSITES (COLLECTIVELY REFERRED TO AS "SITE") AND THE INFORMATION POSTED ON THEM ARE MANAGED BY HOTLINE. THESE TERMS GOVERN THE USE OF THE SITE AND APPLY TO ALL VISITORS OF THE SITE, AS WELL AS TO PERSONS USING OTHER SERVICES AND RESOURCES AVAILABLE OR ACTIVATED THROUGH THE SITE (EACH INDIVIDUALLY — "SERVICE", AND COLLECTIVELY — "SERVICES"; THIS TERM INCLUDES THE SITE UNLESS OTHERWISE PROVIDED BELOW).

BY COMPLETING THE AUTHORIZATION PROCESS AND/OR VISITING THE SITE, YOU CONFIRM THAT: (1) YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS; (2) YOU HAVE REACHED THE AGE AT WHICH YOU HAVE THE RIGHT TO ENTER INTO A LEGALLY BINDING AGREEMENT WITH HOTLINE; (3) YOU HAVE THE AUTHORITY TO ENTER INTO THESE TERMS ON YOUR OWN BEHALF OR ON BEHALF OF THE LEGAL ENTITY FOR WHICH YOU USE THE SERVICES. THE TERM "YOU" REFERS TO YOU PERSONALLY OR TO THE APPROPRIATE LEGAL ENTITY ON WHOSE BEHALF THE SERVICES ARE USED. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS, YOU MAY NOT USE THE SERVICES.

1. Disclaimer of Warranties¶

1.1. Provided "as is". The site, services and software are provided on an "as is" and "as available" basis, with all defects. Hotline expressly disclaims all warranties and representations, express or implied, with respect to the site, services and software, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. You acknowledge that to the extent permitted by applicable law, all risks associated with the use of the site, services and software reside entirely with you.

2. Limitation of Liability¶

2.1. Disclaimer of liability. In no event shall Hotline be liable for any lost profits, loss of revenue or data, indirect, incidental, special or consequential damages, or damages resulting from loss of production or ability to use, interruption of business or need to purchase replacement goods or services, arising out of or in connection with the services or caused thereby, even if Hotline has been advised of the possibility of such damages, and regardless of the legal theory on which the claim is based.

3. Term and Termination¶

3.1. Term. These Terms remain in full force and effect for as long as you have access to or use the Site, Services or Software, unless terminated earlier in accordance with this Section 3.

3.2. Termination by Hotline. Hotline may terminate the provision of any or all Services and/or terminate these Terms at any time and for any reason. Without limiting the foregoing, we may also terminate your access to any or all Services if you materially breach any provision of these Terms or if Hotline is required to do so by legal requirement (for example, if providing the Services is or becomes illegal).

3.3. Termination by You. These Terms terminate with respect to you if you cease any use of the Services and Software and no longer visit the Site.
